Payment terms:

• Reverse engineer or attempt to extract the source code of our software.

To the maximum extent permitted by law, Horizon Hosting shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your use or inability to use our services.
• Any unauthorized access to or use of our servers and/or any personal information stored therein.
• Any interruption or cessation of transmission to or from our services.
• Any bugs, viruses, trojan horses, or the like that may be transmitted to or through our services by any third party.
• Any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the services.

In no event shall our total liability to you for all claims exceed the amount you paid to us during the twelve-month period prior to the event giving rise to the liability.

Our services are provided on an "AS IS" and "AS AVAILABLE" basis, without warranty of any kind, express or implied. We do not warrant that:

• Our services will meet your specific requirements.
• Our services will be uninterrupted, timely, secure, or error-free.
• The results obtained from using our services will be accurate or reliable.
• Any errors in our services will be corrected.

We expressly disclaim all warranties, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

You agree to defend, indemnify, and hold harmless Horizon Hosting, its officers, directors, employees, and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from:

• Your use of and access to our services.
• Your violation of any term of these Terms.
• Your violation of any third-party right, including without limitation any copyright, property, or privacy right.
• Any claim that your content caused damage to a third party.

This defense and indemnification obligation will survive these Terms and your use of our services.

These Terms shall be governed and construed in accordance with the laws of the jurisdiction where Horizon Hosting is established, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms or our services shall be resolved exclusively in the courts of that jurisdiction. You consent to the personal jurisdiction of such courts and waive any objection to such jurisdiction or venue.

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
